# Disclaimer

Last updated: 11 October 2026

SafetyLM (“the Service”), operated by Arrley Pty Ltd (ABN 87 701 846 148), trading as SafetyLM, produces general guidance on Work Health and Safety and Occupational Health and Safety matters in Australia and New Zealand. This Disclaimer is part of the [Terms of Use](https://safetylm.ai/terms), and the Service asks you to acknowledge its three main points the first time you use it.

## What the Service answers from

A practitioner’s knowledge base, published regulator and industry documents, notes we have written from published documents, and the web when an answer depends on what is current. Not legislation.

The Service’s knowledge base holds no Acts or Regulations. When it names a section or a regulation, for example s 27 or reg 292, the reference comes from a practitioner’s summary of the law, from a published guidance document, from a web page it read, or from the language model itself. A web page it reads for a current answer can be a page of a legislation register; the answer cites it as a web page with the date it was read.

How an answer is made. A practitioner’s instruction set shapes the answer’s voice, its frameworks and its jurisdiction rules. The passages of the knowledge base most relevant to your question are retrieved and given to the model as evidence; when the question depends on what is current, the Service searches the web and gives the model what official pages say; when you attach a document, the model reads it. Each section the answer cites (up to ten in a single list) is then checked against that material. A cited section that a passage also cites is shown as found in the sources; one that is not is shown as not found, treat as unverified. Neither result confirms the law. “Found” means the section appears in a passage the Service retrieved, which is a summary or a guidance document, never the Act itself.

One rule is enforced by the system, not by the model. A question that asks for a penalty figure in a jurisdiction for which the Service holds no verified figure is declined before any model is called, every time. Everything else the Service says is subject to the limitations below.

The Service does not answer from primary Australian and New Zealand legislation, and does not give section-level citations to an Act or Regulation. That gap is stated here because it is the most important thing to understand about what you are reading.

## Not legal advice

The Service is not legal advice and does not create a solicitor-client, adviser-client or any other professional relationship between you and us.

Where an answer touches on:

- statutory obligations under any Act or Regulation;
- the rights or duties of any person under the Work Health and Safety Act 2011 or a state or territory equivalent, the Occupational Health and Safety Act 2004 (Vic), or the Health and Safety at Work Act 2015 (NZ);
- industrial manslaughter, Category 1, 2 or 3 prosecutions, or officer due diligence;
- regulator notifications, notices or inspections;
- coronial, civil or criminal proceedings;

obtain advice from a qualified Australian or New Zealand legal practitioner with current admission and relevant experience before acting on it.

## Not a substitute for current regulatory text

WHS and OHS legislation, regulations, codes of practice, Australian and New Zealand Standards and workplace exposure standards change frequently. The Service’s knowledge base is a snapshot in time, and the web search reaches only what a page says on the day it is read. The Service does not assert that any provision it describes is current.

Before relying on any specific regulatory claim, citation or figure, check it against the current authoritative source for the jurisdiction:

Victoria is not harmonised. It never adopted the model WHS laws and operates under the Occupational Health and Safety Act 2004 (Vic). Western Australia harmonised under the Work Health and Safety Act 2020 (WA) from 31 March 2022.

## Not a substitute for qualified practitioners

The Service is designed to help qualified WHS, OHS and EHS practitioners and managers work efficiently. It is not a substitute for the professional judgement of a person with the relevant training, experience and accreditation.

It must not be relied on as the sole basis for:

- incident investigation findings in matters involving a fatality, a serious injury or a notifiable event;
- risk assessments for high-risk construction work, Major Hazard Facilities or high-energy hazards;
- a response to a regulator’s notice (improvement, prohibition or non-disturbance);
- legal proceedings of any kind;
- the design of safety-critical engineering controls;
- medical surveillance or fitness-for-work determinations.

## Limitations of AI-generated content

The Service is built on large language models. The model that answers is the one named in the question box; Settings › About names the default and Settings › Data and privacy says where each model runs. Like all large language models, they can:

- produce confident-sounding but incorrect statements;
- omit facts you would consider important;
- conflate similar but distinct provisions or codes;
- invent document references, section numbers, penalty amounts or case citations that do not exist;
- apply outdated information from their training.

The Service reduces these failures where it can: a penalty question with no verified figure is refused rather than answered; answers are drawn from retrieved material that names its source; every cited section is checked against that material; and a second pass reads each regular answer before you see it. These measures reduce the risk; they do not remove it. You are responsible for verifying every material claim before acting on it.

## Penalty figures

Penalty unit values are held only for jurisdictions with a verified figure: the Commonwealth, New South Wales, Victoria, Queensland and the Northern Territory, and the fixed unit that applies to offences under Queensland’s Work Health and Safety Act 2011. Every figure carries the date it was current as at, and the Service shows that date with the figure.

Western Australia, South Australia and New Zealand set WHS penalty maxima as dollar amounts in their Acts rather than as penalty units. Tasmania and the Australian Capital Territory use penalty units for which the Service holds no verified current value. For all five, the Service holds no sanctioned penalty figure and declines to state one, because stating one would mean estimating it.

## Limitation of liability

The [Terms of Use](https://safetylm.ai/terms) set out the limits of our liability and the rights the Australian Consumer Law and New Zealand consumer law give you, which nothing in this Disclaimer excludes. In short: to the extent the law allows, we are not liable for loss arising from your use of the Service, from your reliance on an answer, from an error or omission in an answer, or from a decision made or an action taken on the strength of one.

By using the Service you acknowledge that you have read and understood this Disclaimer.
